1. Acceptance of Terms

By using the App, you confirm that you are at least 13 years old (or the age of majority in your jurisdiction) or have parental consent if under 18. Users under 13 are prohibited from using the App. You agree to comply with these Terms, our Privacy Policy (5dwaves.com/privacy), and all applicable laws, including consenting to data processing as described in our Privacy Policy.

2. Description of Service

5D Waves provides tools for personal development, including meditation content and audio experiences. Premium features are available via subscription:

  • Monthly Plan: $11.99 per month, billed monthly.
  • Annual Plan: $59.99 per year, billed annually.

Subscriptions are managed through the Apple App Store or Google Play Store and auto-renew unless canceled before the renewal date. You can manage or cancel subscriptions via your account settings or the respective app store. Free users have access to limited features.

3. User Accounts

To access certain features, you may need to create an account. Your account data is managed securely via Supabase. You are responsible for maintaining the confidentiality of your account credentials and all activities under your account. Notify us immediately at will@5dwaves.com if you suspect unauthorized use.

4. Subscriptions and Payments

Subscriptions are processed via third-party payment processors (e.g., Apple App Store, Google Play Store). By subscribing, you agree to pay the applicable fees and authorize recurring charges until cancellation. Cancellations must be made through your app store account settings (see Apple's refund policy or Google's refund policy).

  • Prices are subject to change, but we will notify you before any changes apply to your subscription.
  • You can cancel at any time, but no refunds are provided for partial periods unless required by law. Refunds may be provided at our discretion or as required by applicable law.

5. Intellectual Property

The App and its content (e.g., text, graphics, logos) are owned by 5D Waves or its licensors and are protected by copyright, trademark, and other laws. You may not reproduce, distribute, or modify the App's content without permission.

6. User Conduct

You agree not to:

  • Use the App for unlawful purposes.
  • Attempt to bypass or disable security features or subscription restrictions.
  • Harass, abuse, or harm other users or 5D Waves.

7. Termination

We may terminate or suspend your access to the App if you violate these Terms or fail to pay subscription fees. Upon termination, your right to use the App will end, and your data will be deleted as described in our Privacy Policy. You may still be liable for any outstanding fees.

8. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the App will be uninterrupted, error-free, or secure.

9. Limitation of Liability

5D Waves will not be liable for any indirect, incidental, or consequential damages arising from your use of the App, including lost profits or data, even if we've been advised of the possibility of such damages.

10. Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of laws principles. For users in the European Union, mandatory data protection or consumer rights (e.g., under GDPR) are governed by the laws of your EU country of residence, with disputes handled in your local courts, as required by law.

11. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted here with an updated "Last Updated" date, and we will notify you of significant changes via email or in-app notifications. Continued use of the App after changes constitutes your acceptance of the new Terms.

Your use of the App is also subject to our Privacy Policy, available at 5dwaves.com/privacy.
