1. Acceptance of Terms

By using 5D Waves ("the App"), you confirm that you are at least 13 years old (or the age of majority in your jurisdiction) or have parental consent if under 18. Users under 13 are prohibited from using the App. You agree to comply with these Terms, our Privacy Policy, and all applicable laws.

2. Description of Service & Account-Free Design

5D Waves provides ambient music, generative soundscapes, and audio tools to help you relax, focus, and clear your mind. The App is designed with an account-free architecture: you do not need to register, log in, or create a profile to enjoy 5D Waves.

Select premium soundscapes and advanced synthesizer capabilities are available via an optional auto-renewing subscription:

• Monthly Plan: $11.99 per month, billed monthly.
• Annual Plan: $59.99 per year, billed annually.

Subscriptions and purchases are processed and managed entirely through your Apple App Store or Google Play Store account. Your subscription privileges are linked directly to your store account ID without requiring any personal login credentials. Free users have ongoing access to select complimentary soundscapes and features.

3. Subscriptions and Payments

Subscriptions are billed and processed through third-party platforms (e.g., Apple App Store, Google Play Store). By subscribing, you authorize recurring charges via your app store account until canceled. Subscriptions auto-renew unless auto-renew is turned off at least 24 hours before the end of the current billing cycle.

You can manage, change, or cancel subscriptions at any time through your device's app store settings:

• See Apple's cancellation and refund guidelines.
• See Google Play's cancellation and refund guidelines.
• Prices are subject to change, but any price modifications will be announced in advance through standard app store notification procedures before renewing.
• Unless required by applicable local law, payments are non-refundable for partial subscription periods.

4. Intellectual Property

The App, including its audio tracks, synthesizer algorithms, visual designs, graphics, branding, and code, is owned by 5D Waves or its licensors and is protected by copyright, trademark, and intellectual property laws. You are granted a personal, non-exclusive, non-transferable license to stream and use the App for personal, non-commercial purposes. You may not reproduce, redistribute, re-broadcast, or extract audio assets from the App without express written permission.

5. User Conduct

You agree not to:

• Use the App for any unlawful or unauthorized purpose.
• Attempt to decompile, reverse engineer, intercept, or circumvent audio streaming security or subscription entitlement mechanisms.
• Interfere with, overload, or disrupt 5D Waves streaming servers, networks, or infrastructure.

6. Termination & App Removal

Because 5D Waves does not hold user accounts or personal profiles, you may stop using the App at any time by deleting it from your device. If you hold an active subscription, ensure you cancel it directly within your Apple App Store or Google Play account to stop future recurring charges. We reserve the right to suspend or discontinue services or terminate access to the App for any user who violates these Terms.

7. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express, statutory, or implied. 5D Waves does not guarantee that audio playback will be uninterrupted, error-free, or compatible with all hardware and operating systems.

8. Limitation of Liability

To the fullest extent permitted by applicable law, 5D Waves and its creators will not be liable for any indirect, incidental, special, or consequential damages arising out of your use or inability to use the App, even if advised of the possibility of such damages.

9. Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles. If you reside in the European Union or United Kingdom, mandatory consumer protection laws and statutory rights of your home jurisdiction remain unaffected.

10. Changes to These Terms

We may revise these Terms occasionally to reflect feature updates or legal requirements. Updated versions will be posted on this page with an updated "Last Updated" timestamp. Continued use of the App following any changes indicates your acceptance of the revised Terms.

Your use of the App is also governed by our Privacy Policy.

1. Information We Collect

We believe in minimal data collection. We only collect or interact with information strictly necessary to provide the App's functionality:

• No User Accounts: We do NOT require you to create an account, log in, or provide your name, email address, or phone number to use the App.
• Support Correspondence: If you voluntarily reach out to us via email for support or feedback, we receive your email address and any information you provide in your message solely to respond to and resolve your inquiry.
• In-App Purchases & Subscriptions: All transactions are processed directly by Apple (App Store) or Google (Google Play Store). 5D Waves never receives, processes, or stores your credit card numbers, bank information, or billing address. We use RevenueCat to validate your subscription receipts anonymously with the app stores to unlock premium audio.
• Diagnostics & Technical Telemetry: We collect non-personally identifiable diagnostic data (such as app version, device model, operating system, and crash logs) via Firebase Crashlytics to diagnose bugs, monitor performance, and prevent crashes.
• Audio Delivery & Server Logs: When streaming ambient soundscapes via our content delivery network (Cloudflare), temporary standard HTTP request logs (such as IP address and user-agent) are processed solely to deliver audio files reliably and protect against network abuse.
• Local Device Storage: Your preferences (e.g., custom binaural beat frequencies, soundscape choices, favorites) are stored locally on your device using on-device storage. This data is never synchronized to remote user profiles.

2. How We Use Your Information

We use the limited data described above solely to:

• Stream and deliver ambient soundscapes, frequencies, and features.
• Verify active subscription status anonymously to unlock Pro soundscapes.
• Identify technical glitches, resolve crashes, and enhance overall app stability.
• Respond directly to customer support emails initiated by you.

We do not track you across third-party websites or apps, and we do not use your information for targeted advertising.

3. How We Share Your Information

We do not sell, rent, or trade your personal data. We only work with trusted service providers necessary to operate the App:

• Apple App Store / Google Play Store: Secure payment and in-app purchase handling.
• RevenueCat: Anonymous subscription status verification.
• Google Firebase: Crash reporting, stability monitoring, and remote feature configuration.
• Cloudflare: High-performance content delivery and secure audio streaming.
• Legal Requirements: We may disclose information if required to comply with a valid legal obligation, court order, or governmental regulation.

4. Data Security

We implement industry-standard security protocols, including HTTPS/TLS encryption for all audio streaming and receipt verification. Because we do not store user accounts or passwords on our servers, there are no centralized user databases or account credentials vulnerable to credential compromise.

5. Data Retention

• Account Data: None. Because 5D Waves does not operate user accounts, no profile or credential records are retained.
• Device Preferences: Saved locally on your device until you reset app data or uninstall the App.
• Support Emails: Stored in our support inbox only as long as necessary to resolve your inquiry, after which they are archived or deleted.
• Crash & Performance Logs: Retained by Firebase for standard diagnostic retention periods (up to 90 days).

6. Your Rights & Choices

• No Account Deletion Needed: Because 5D Waves has no user accounts or user database, there is no online profile to delete. You can erase all local data at any time by simply uninstalling the App from your device.
• Subscription Management: You have full control over your subscription at all times. You can manage or cancel your auto-renewal directly through your Apple ID (iOS Settings > Subscriptions) or Google Play Store (Profile > Payments & subscriptions).

7. Children's Privacy

5D Waves is not directed to children under 13, and we do not knowingly collect personal information from children. If you believe that a child has provided us with personal information via email, please contact us immediately, and we will delete it promptly.

8. International Data Transfers

Any technical data processed by our third-party infrastructure partners (such as Cloudflare or Firebase) may be routed through servers in the United States or other global data centers in compliance with applicable international data transfer frameworks.

9. Changes to This Privacy Policy

We may update this Privacy Policy periodically. Any revisions will be published on this page with an updated "Last Updated" date. We encourage you to review this page periodically.

Your use of the App is also subject to our Terms of Service.

• Do I need to create an account?
  No! 5D Waves is 100% account-free. There are no passwords to remember, no email signups, and no personal profile requirements. Your experience starts immediately upon opening the app.
• How do I restore my Pro subscription on a new device?
  Since subscriptions are tied directly to your Apple ID or Google Play account rather than a login, simply tap the Unlock Pro button in the app and tap Restore Purchases. Your Pro access will activate instantly.
• How do I manage or cancel my subscription?
  You can manage or cancel your subscription at any time via your device's native store settings:
  • iOS: Open the Settings app on your iPhone > tap your Name / Apple Account > Subscriptions > 5D Waves.
  • Android: Open the Google Play Store > tap your profile icon > Payments & subscriptions > Subscriptions > 5D Waves.
• Soundscapes not playing or streaming slowly?
  5D Waves streams high-fidelity ambient soundscapes from our content delivery network. Ensure your device has an active Wi-Fi or cellular internet connection. If issues persist, force-close and restart the app.
• How can I request new soundscapes or features?
